The attorneys at our law firm are often asked some version of the following questions:

The simple answer is NO, don’t do it.  There is no legal upside to you dating while going through a divorce in Georgia and if you choose to date or be in another relationship during your divorce it can have negative consequences on your case.  There is no such thing as a “legal separation” filing in Georgia unlike some other states.  And if you engage in sex with someone other than your spouse while married then you have committed adultery which is a fault ground for divorce in Georgia.

Dating before being divorced can negatively impact alimony, child custody, and/or parenting time.  It doesn’t mean that dating before you’re divorced WILL have a negative impact, you just need to be aware that there is risk that it MIGHT.  As divorce lawyers, one of our goals is to minimize risk for you, and there is indeed risk if you decide to date or enter into a new romantic relationship prior to your divorce being finalized.  This is especially true in contested cases.

Who you have dated (and everything related to that) is potentially discoverable.  Do you really want to have to list out the people you have gone on dates with or provide copies of your online dating profiles?  And do you think dating a new person is going to help get your case resolved when emotions are already running high?  For those reasons alone it is not a good idea to date someone (or more than one person) while going through a divorce.

In this regard, California is a progressive state. While some states frown heavily upon extramarital affairs, even after a physical separation between the spouses, that’s not how the California courts view it.

In California, divorcing couples are free to date during their divorces without any consequences from the courts. Even if a couple is separated and one spouse enters into a new relationship, that does not bar them from receiving spousal support.

The only time dating becomes a concern is when a spouse is wasting marital assets on a new partner. If it can be proven that a spouse spent marital assets, for example, if a husband bought his new girlfriend a car, then it can affect property division. Otherwise, dating won’t usually impact the outcome of a California divorce.

If you plan to date before your divorce is finalized, remember, discretion is important. You wouldn’t want to say or do anything that could turn a friendly divorce into a contested one because litigated divorces can be costly. If you’re sleeping on the couch or if one of you are sleeping in the guest bedroom, hold off on the dating app until you’re no longer living together. Other than that, here’s our advice:

  • Consider talking to your ex about dating.
  • Be discreet!
  • Avoid taking your date places where your ex frequents.
  • Consider group outings instead of one-on-one dates.
  • Consider dating in a neighboring town to avoid running into your ex.

"As much as I wanted to pick people based on their personality, I found all profiles were basically the same," he told Business Insider. I looked for pictures that expressed some of the person's personality, doing things they enjoy."

Michelle, a 54-year-old who asked to withhold her last name, has been divorced three times.

"As a woman in her 50s, dating just isn't as fun as it used to be," she told Business Insider. "Between kids, divorces, mortgages, careers, and starting life over again, there are challenges in trying to find 'the one' for the last time."

While she'd met her first two husbands in person — in high school and through her family — she met her third husband on Match.com in 2005. But she said online dating then was different than it is now.

"Online dating was new, and people were much more sincere about dating and less online dating during separation she said. "Now, there are so many people who create fake accounts and try to scam people, and the newer generation of online dating creates a 'sell your wares' shopping mentality, like Amazon."

Every so often, she'd sign up for a new dating site, but she began to realize that she missed familiarity so much, it became work to make the effort to tell her story over and over again. It made her realize that she needed something different in a relationship.

"By my age now, I realize that I am no longer interested in dating, but would like to have a monogamous relationship that is comfortable, casual, and easy," she said. "And if we ever live together, it would have to be in a duplex, because I really like my little world."

One latecomer to the world of online dating said that not being in the same physical space as the person you're interacting with has changed his approach to romance.

Mike Darcey, a 55-year-old who was married for 20 years, said that "dating has definitely changed" since the last time he was single.

But now, he said it seems being in the same space together is something that happens afterward.

Christine Michel Carter, a 33-year-old author on parenting, is a mother of two who is dating after her 10-year marriage ended in divorce.

"Man, is this a new world since I was single," she told Business Insider in an email, online dating during separation. "Facebook barely existed and MySpace was very popular."

Her first post-divorce date was with a former boyfriend, but when it did not work out, she decided to try online dating.

"Dating these days is completely different," she said. "The dates I had with complete strangers were awkward, online dating during separation, as I'd been off the market for so long. It seemed commonplace to have an online dating profile and to be overly flirtatious on it, which I'm not very comfortable with."

Carter was also surprised by the blatant interest in sex or a short-term relationship, she said, whereas she likes to build intimate relationships and connections with one person for a long time.

These days, she also prefers meeting dates in real life, such as colleagues through work, versus online.

"I find that much easier and more comfortable for an introvert like me," she said.

Even the expectation of texting as a main method of communication is enough to rattle people who dated in the pre-internet era.

Glenn Allen, a 38-year-old who was married for 12 years, said the most shocking thing about dating today is how texting and social media have changed the way people communicate.

"When I was dating my ex-wife, we almost never texted — it was about eight years before the iPhone was even invented," he told Business Insider. "We actually emailed and wrote each other notes a lot."

But now, he said texting is a necessary part of keeping a relationship alive.

"If there's a long space — days — between texts, the relationship feels 'off' and disconnected, and usually an indication that something's not right," Allen said.

He also said some dates have felt like people are interviewing for a spouse.

"I have been on the receiving end of that a few times, and it wrecks the date pretty fast," he said.

Finally, the sheer size of the online dating pool can make it difficult for newcomers to tell who's a good match and who's even telling the truth.

Divorce coach Dawn Burnett was married for 15 years, and post-divorce, most of her dates have come from dating apps like Bumble and Plenty of Fish.

Burnett said dating used to be simple — you met someone you liked when you were out at an event, or were introduced by friends and you started dating.

Divorcing clients are often lonely and stressed out, and they may be longing to meet someone new, feel desirable again, and just have fun, so many clients decide that only one date can't hurt.

The Costs of Dating During Divorce

Unfortunately, when it comes to dating during a divorce, there is more that you shouldn't do than should, but first, online dating during separation, let's clarify what's meant by "dating."   • exactly when the relationship began
  • whether it is sexual
  • whether the married spouse transferred any marital property to the new friend, such as by gift

Even if everything is on the up-and-up, the result is that dating while your case is still pending can add a lot of unnecessary aggravation, stress, and possibly even a more complicated and expensive divorce. But, for those unwilling to wait, here are a few guidelines for dating while divorcing:

The Don'ts of Dating During a Divorce

  • Don't even consider dating until you've physically separated from your spouse, even if you or your spouse agree that the marriage is over, online dating during separation. The judge (or your spouse) may decide the new relationship is the reason the marriage failed and (depending on your state's laws) this could lead a judge to award more of the marital assets to your spouse.
  • Once separated, date with the utmost propriety, particularly around your children. Don't do anything in front of them that you wouldn't be comfortable describing to a judge. Avoid introducing your children to your new sweetheart, as it will likely upset your spouse and add to your online dating during separation pain. Introducing a new partner at a very early point in the relationship is not a good idea for your children, and making bad decisions like this could compromise your future custody rights. If you'd rather not leave your future dating life up to a judge, you can work with your spouse to create a marital settlement agreement that addresses future relationships and introductions to your children in a way you and your spouse are comfortable with.
